Motorcyclists by and large are an avid bunch. They are passionate about their bikes, and take to the road with an eagerness rarely shared by motorists who confine themselves to the closed cabs of automobiles. Unfortunately for motorcyclists, there is also no other motor vehicle more dangerous. Motorcycle accidents often leave victims with lifelong disabilities. If you are among those unfortunate enough to be injured in an accident because of another’s negligence, there is good news in that you may be able to gain compensation. When you pursue your claim, however, you should hire a strong attorney. The attorneys at Nadrich & Cohen, LLP have the experience and knowledge of personal injury law to provide you with a strong chance of success.

The Disturbing Statistics

Motorcycles by design are open and offer no protective barrier between the other vehicle and the rider should a collision occur. Because they have but two wheels and depend upon balance and forward momentum to remain upright, motorcycles are also prone to falling over. A rock or pothole in the roadway is enough to cause the biker to lose his balance. When this occurs, the full weight of the motorcycle is brought to bear upon the motorcyclist as the momentum continues and the bike and rider skid along the asphalt.

It should come as no surprise that injury is almost certain when an accident occurs. Moreover, the injuries bikers suffer are more likely to be serious. Fatalities are frequent. In fact, according to the National Highway Traffic Safety Administration motorcyclists are 35 times more likely to die in motor vehicle accidents that are passengers in cars. The City of Murrieta reports that in 2012 one person lost his life and eleven were injured in motorcycle accidents. A disturbing trend upward in injury accidents has been observed since the mid-1990s as well: during a ten year period motorcycle accidents and their resultant injuries doubled and have remained high ever since.

Common Causes of Accidents and Injuries

The causes of motorcycle accidents are many, but a few cause the majority of injury accidents. Among the most common causes of accidents are:

  • Excessive speed
  • Inclement weather
  • Lane splitting, which is when the biker drives between two lanes
  • Turning into the path of the motorcycle
  • Driving under the influence
  • Hostile actions toward the motorcyclist
  • Inattentiveness
  • Failure to see a motorcycle

This last factor has led to numerous studies that have brought inconclusive results. In essence, other motorists often simply fail to see motorcycles, and researchers are not sure why.

Among the most common injuries suffered in motorcycle accidents are lacerations, burns, crushed limbs when the motorcycle falls on the rider, back and neck injuries, trauma to the head, and traumatic brain injury. Studies have shown that the use of helmets greatly reduces the risk of head and brain injury. Unfortunately since the mid-1990s the number of states requiring helmets has actually decreased. California is one of the states that still requires the wearing of a helmet.

What to Do if You Are Injured in a Motorcycle Accident

It is easy to panic when facing injury in an accident. It is important that you try to keep a level head and take steps that will greatly benefit your case later on. First and foremost, have a doctor examine you even if you don’t think you have been injured. Once you have determined that you are not in imminent danger check passengers in other vehicles to see whether they need immediate help, and then call 911. While waiting for the police take pictures of the accident scene with your cell phone, obtain contact information from any witnesses, and get the name, phone number and insurance information from the person who hit you. Finally, if you pursue a claim, work with a personal injury attorney. Call Nadrich & Cohen, LLP today to schedule a consultation.
