San Bernardino County Agrees to $3 Million Settlement in Motorcycle Accident Injury Case

The settlement agreement brings closure to the woman injured in a motorcycle accident that occurred on a Mojave desert road in 2007.

Lisa Hermann filed the lawsuit in 2009 over injuries she sustained when she and motorcycle driver Vanjaymes Tonies crashed on Kelso-Cima Road near the Nevada border. Ms. Hermann named both the state of California and San Bernardino County, but the state's liability claim was dismissed in October 2011.

According to a San Bernardino County spokesperson, the road had been washed out after several days of heavy rain, which created a deep trench. Repair crews had not had an opportunity to fix the road or put up warning signs when the accident occurred. The road has since been graded periodically to prevent further accidents.

Ms. Hermann claimed that she suffered severe head and neck injuries as a result of the accident and that these injuries have left her permanently disabled. As part of the $3 million settlement, San Bernardino County will pay $78,811 to the State Department of Health Care Services for Hermann’s medical bills. Mr. Tonies also filed suit against the county but a settlement is still pending in that case.
