After a Motorcycle Accident, What to Do

Anyone who rides knows the exhilaration, freedom and fun that comes from cruising down a wide-open country road on a beautiful day. Similarly, anyone that rides knows the uneasy, fearful feeling that comes from being boxed in on a busy highway or freeway with a semi truck on either side of you.

Unfortunately, motorcyclists are vulnerable, and, as a result, accidents do happen.

Here’s what you need to do:

  1. The first thing you need to know after a motorcycle accident is that the insurance company will not automatically take care of you and your bills and compensate you for the pain and suffering you have endured. Insurance companies, unfortunately, are not your friend. They do not care, and all they are interested in is paying you a minimum amount for your claim. Remember, their objective every time is to pay the least and close the file.
  2. As soon as possible, you should photograph any of your visible injuries (cuts, bruises, broken bones, etc.)
  3. Before repairing your motorcycle, photograph the damage from all angles. Provide your lawyers with the prints or negatives or digital images of all photographs.
  4. Consult with a motorcycle specialist – hopefully our law firm – to determine who is responsible for the payment of your medical bills. Do not count on your insurance company to take care of your medical bills.
    Your medical bills should be processed through the at-fault auto or truck’s insurance company, your motorcycle insurance policy or through medical insurance. Remember, most insurance policies require reimbursement to them of any medical expenses they paid if you obtain a settlement from the at-fault party. We would have your insurance company pay to have your motorcycle repaired or pay you the value of the bike if it is a total loss. They would then be reimbursed by the at fault insurance company who is obligated by law to pay for all of your damages and expenses.
  5. Keep accurate records of your lost time and wages from the accident. That will help us or your lawyer determining the additional claims for loss of wages that we will seek on your behalf.
  6. Be sure you’re going to the best doctors who specialize in taking care of the type of injuries that you suffered in the motorcycle accident.
  7. If you know of any witnesses, track them down and provide your lawyers (hopefully us) with their phone numbers.
  8.
